Rules and Regulations
OFFICIAL RULES AND REGULATIONS
This Contest is intended for viewing and participation in Canada only (excluding
Quebec) and is governed by the laws of Canada. Please do not proceed if you
are not a legal resident of Canada at the time of entry.
1) CONTEST DESCRIPTION
The Contest consists of the submission of a contest entry whereby winners
are determined by a random draw. Only one entry per person is allowed. No
purchase is necessary to enter.
2) CONTEST PERIOD
The Contest registration period is in effect as of March 27, 2012, at 10:00am
until midnight June 15, 2012. Any entries submitted outside of this time period by
any means whatsoever, including hand delivery in person or via mail or any other
delivery service, will be considered invalid and ineligible for entry into the contest.
3) ELIGIBILITY
To enter for a chance to win any of the prizes in connection with this Contest, a
person must be a legal resident of Canada who has reached the age of majority
in their province or territory of residence.
Persons in any of the following categories are NOT eligible to participate or
win prizes in the Contest:
(A) any person who, at any time on or after March 27, 2012, was or is a director,
officer, employee or agent in connection with Le Québec maritime, Motorcycle
Mojo, prize suppliers or any of their respective divisions, parent, subsidiary, or
affiliated companies;
(B) individuals engaged in the development, production or distribution of
materials for the Contest (collectively the “Contest Entities”);
(C) any person domiciled with any of the above;
(D) any person domiciled in Quebec.
4) HOW TO ENTER & PLAY
To enter the contest Maritime Regions of Quebec (the “Contest”), a contest
participant must do the following:
(A) Register online via the Contest registration form
at www.motorcyclemojo.com;
5) CONTEST PRIZE DESCRIPTION
All winning contest participants will be decided by random draw to occur
at the offices of Motorcycle Mojo, on June 18, 2012 between the hours
of 9:00am EST and 5:00pm EST. Every attempt will be made to contact
the winning participant as soon as possible. If a winning participant
cannot be contacted after a reasonable amount of time equal to 30
days, the prize will be considered as forfeited and will be awarded, by
process of random draw, to another eligible contest participant.
Failure to accept the prize as awarded the winning participant will constitute
forfeiture of the prize. Prize will then be awarded, by process of random draw,
to another eligible contest participant. No cash alternative or substitution of any
prize will be provided, except that Le Québec maritime, in its sole discretion,
reserves the right to substitute a prize of equal or greater value if, for any reason,
the prize as described cannot be awarded.
6) CONDITIONS OF PARTICIPATION
(A) Motorcycle Mojo and Le Québec maritime is not responsible for late, lost,
damaged, misdirected, mutilated, garbled, illegible, or incomplete entries.
(B) Entries generated by script, macro, robotic, programmed, or any other
automated means are prohibited and will be disqualified;
(C) If a dispute arises regarding as to who submitted an online entry, the entry
will be deemed to be submitted by the authorized account holder of the email
address provided at time of entry. The authorized account holder is defined as
the natural person who is assigned to an email address by an Internet access
provider, online service provider or other organization responsible for assigning
email addresses for the domain associated with the submitted email address;
(D) Contest participants and/or winner assumes liability for any injuries caused,
or claimed to be caused, by participating in the Contest, by the acceptance,
possession, or use of any prize awarded, including but not limited to claims/
damages for personal injury, or property damage;
(E) Potential winner may be required to furnish proof of identification that may
include a driver’s license issued in Canada and/or a Canadian social insurance
number. If a potential winner is found to be ineligible, declines to accept the
prize, or in the event that a prize confirmation or prize is returned undeliverable,
the prize will be forfeited. By participating in the Contest, or by accepting a
prize, winner consents to the use of their name, address, voice and statement
relating to the Contest and photographs or other likenesses, without further
compensation, in any publicity carried out by Motorcycle Mojo and Le Québec
maritime in connection with this Contest, except where prohibited by law;
(F) Motorcycle Mojo, Le Québec maritime and the Contest Entities do not
warrant that access to or use of online services will be uninterrupted. Motorcycle
Mojo, Le Québec maritime and the Contest Entities are not responsible
for any problems that may arise, including but not limited to; (a) lost,
interrupted, inaccessible or unavailable networks, servers, satellites, internet
service providers, websites, or other connection, availability or accessibility
problems arising in connection with or over the course of the Contest; or (b)
communications, failed, jumbled, scrambled, delayed, or misdirected computer,
telephone or cable transmissions or hardware or software malfunctions, failures
or difficulties; or (c) failure of personal computers and/or software and hardware
configurations, any technical malfunctions, failures, or difficulties, printing errors,
clerical, typographical or other error in the offering or announcement of any
prize or in any prize notification documents; or (d) for any errors of any kind in
connection with the Contest, whether human, mechanical, clerical, electronic, or
technical in nature; or (e) the incorrect or inaccurate capture of information, or the
failure to capture any information in connection with the Contest; or (f) damage to
a user’s system occasioned by participation in this Contest or downloading any
information necessary to participate in this Contest.
7) OTHER DISCLOSURES
(A) Any attempt by a participant or other individual to deliberately damage any
website or undermine the legitimate operation of this Contest, including but not
limited to any fraudulent claims, is potentially in violation of criminal and civil
laws. Should such an attempt be made, Motorcycle Mojo reserves the right
to seek remedies and damages from any such individual, to the fullest extent
permitted by law, including criminal prosecution. Any participant engaging in any
of the foregoing activities may be disqualified and will forfeit any prizes won;
(B) Motorcycle Mojo reserves the right to suspend, cancel or modify the Contest
at any time, if fraud, technical failures including any network server or hardware
failure, viruses, bugs, errors in programming, or any other errors or other causes
beyond the control of Motorcycle Mojo corrupt the administration, security,
integrity, or proper play of the Contest;
(C) Prizes pictured in point-of-sale, television and print advertising, promotional
packaging, and other Contest materials are for illustrative purposes only. All prize
details, and any restrictions related to any prize or prizes, will be provided to the
applicable prize winner upon the award of the prize. No prize will be awarded to
any participant who fails in any way to comply fully with these Official Rules and
Regulations. The approximate retail values of prizes as stated by Le Québec
maritime in point-of-sale, television and print advertising, Contest materials,
and/or in these Official Rules and Regulations are subject to price fluctuations in
the consumer marketplace based on, among other things, the passage of time
between the date, the approximate retail values as stated by Motorcycle Mojo
and the date the prizes are awarded or redeemed;
(D) All issues and questions concerning the construction, validity, interpretation,
and enforceability of these Official Rules and Regulations, or the rights and
obligations of a contest participant in connection with the Contest, shall be
governed by, and construed in accordance with, the substantive laws of the
Province of Ontario without regard to Ontario conflicts of law principles. All
participants consent to the jurisdiction and venue of the Province of Ontario;
(E) The invalidity or unenforceability of any provision of these Official Rules
and Regulations shall not affect the validity or enforceability of any other
provision. In the event that any provision is determined to be invalid or otherwise
unenforceable or illegal, these Official Rules and Regulations shall otherwise
remain in effect and shall be construed in accordance with their terms as if the
invalid or illegal provision were not contained herein. In particular, Motorcycle
Mojo employees are not authorized to waive, modify or amend any provision or
provisions of these Official Rules in any manner whatsoever;
(F) Personal information collected from participants will be collected and used
by Motorcycle Mojo for the purpose of administering this Contest. Participant
will be provided with an Opt-Out option as follows: “Occasionally we are asked
to provide various information to select companies in the industry. If you would
prefer not to receive information from other manufacturers or not have your
information shared, please check here.” Motorcycle Mojo will not sell, share or
otherwise disclose the personal information of Opt-Out participants, other than
for the sole purpose of administering this Contest or as permitted or required by
law. Participants not choosing this Opt-Out option will have the status of Opt-
In participants. By entering the Contest, a participant consents to the manner of
collection, use and disclosure of personal information as set out in these Official
Rules and Regulations and in Motorcycle Mojo’s Privacy Policy.;
(G) Contest participants acknowledge compliance with these Official Rules and
Regulations including all eligibility requirements and, agree to be bound by the
decisions of Motorcycle Mojo, made in their sole discretion, which shall be final
and binding in all matters relating to this Contest. Participants who have not
complied with these Official Rules and Regulations are subject to disqualification.
